Welcome to The Guest Agency. These Terms & Conditions apply to your use of our website, purchases made through our online store, including The Considered Brand workbook and the 2027 Marketing Planner, and any services booked with The Guest Agency.
By accessing our website, purchasing a product or engaging our services, you agree to the applicable terms set out below. Please read them carefully before proceeding.
1. About The Guest Agency

2. Website Use
You may use our website for lawful purposes and in accordance with these terms.
You agree not to misuse our website, attempt to gain unauthorised access to its systems, interfere with its operation or use its content in a way that infringes our rights or the rights of others.
We aim to keep our website accurate and accessible but cannot guarantee uninterrupted availability or that all content will always be current or error-free.
3. Digital Products
The Considered Brand, the 2027 Marketing Planner and any other digital products offered by The Guest Agency are supplied as downloadable digital content.
Product descriptions, inclusions and prices will be displayed on the relevant product page before purchase. Please review these details before completing your order.
Following successful payment, you will receive instructions to access your digital product via the email address provided at checkout. Please check your inbox and junk or spam folder if your confirmation email does not arrive.
If you experience difficulty accessing your purchase, please contact us so we can assist.
3.1 Personal Use and Intellectual Property
Purchasing a digital product grants you a limited, non-exclusive, non-transferable licence to use the product for your own personal or internal business purposes.
Unless we provide written permission, you must not:
Reproduce, redistribute, share or resell the product, in whole or in part.
Upload or distribute the product through public websites, file-sharing platforms or other channels.
Repackage, reproduce or adapt the product for commercial resale or distribution.
Claim the product, its content or its design as your own intellectual property.
All intellectual property rights in our digital products, including The Considered Brand, the 2027 Marketing Planner, their written content, frameworks, planning prompts, templates and designs, remain with The Guest Agency unless otherwise stated.
You may apply the ideas, exercises and planning tools in our digital products to your own business. However, purchasing a digital product does not grant ownership of its underlying content, templates, frameworks or design, or permission to reproduce or distribute them commercially.
4. Pricing and Payment
All prices are displayed in Australian dollars (AUD), unless otherwise stated.
Payment for digital products must be completed at checkout before the product is supplied. Payments are processed through the payment facilities available on our website, which is hosted by Squarespace.
We reserve the right to update product prices and service fees at any time. Any price change will not affect an order already completed.
For agency services, fees, payment schedules and any applicable expenses will be outlined in a separate proposal or written agreement.
5. Refunds and Consumer Rights
Due to the nature of digital products, we do not generally offer refunds for change-of-mind purchases once a digital product has been supplied or made available for download.
However, this policy does not exclude, restrict or modify any rights or remedies available to you under applicable consumer protection laws.
If a digital product is faulty, inaccessible, materially different from its description or otherwise fails to meet an applicable consumer guarantee, please contact us so we can assess the issue and provide an appropriate remedy in accordance with applicable law.
For agency services, cancellation, rescheduling and refund arrangements will be set out in the relevant proposal or client agreement, subject to any applicable legal requirements.
6. Agency Services and Bookings
The Guest Agency provides tailored marketing, communications and experiences services. All projects are subject to availability, an agreed scope of work and written confirmation.
Submitting an enquiry or project brief does not constitute a booking or guarantee that we will accept a project.
A booking is confirmed when you have accepted our written proposal or agreement and completed any initial payment required to commence the project.
Each proposal or client agreement will outline the applicable services, deliverables, fees, timelines, payment schedule and any project-specific conditions. Where a proposal or agreement differs from these general terms, the project-specific agreement will take precedence to the extent of any inconsistency.
6.1 Scope of Work
The services and deliverables included in a project will be defined in the relevant proposal or written agreement.
Requests that fall outside the agreed scope may require additional fees, revised timelines or a separate agreement. We will discuss material changes with you and obtain written approval before proceeding with additional work.
We will make reasonable efforts to accommodate changes where possible but cannot guarantee that additional requests can be accommodated within the original budget or timeframe.
6.2 Client Responsibilities
Clients agree to provide the information, materials, approvals, feedback and access reasonably required for us to perform the agreed services.
Clients are responsible for ensuring that any materials they supply to us may lawfully be used for the purposes of the project.
Delays in receiving information, approvals or feedback may affect project timelines, deliverables and agreed milestones. Where a delay materially affects the project, we will discuss any necessary adjustments with the client.
We are not responsible for delays or additional costs arising from incomplete information, late approvals or changes requested by the client, to the extent permitted by law and the relevant agreement.
6.3 Changes, Cancellations and Rescheduling
If you wish to change, postpone or cancel a confirmed project, you must notify The Guest Agency in writing as soon as reasonably possible.
The applicable cancellation, rescheduling and payment arrangements will be set out in the project proposal or agreement. These arrangements may vary depending on the nature of the project, work already completed, resources committed and any non-refundable third-party costs.
Where a project is cancelled, you remain responsible for fees for work already performed and any approved, non-cancellable costs incurred up to the cancellation date, subject to the agreed terms and applicable law.
Where a project is rescheduled, revised timelines and any additional costs will be discussed and agreed in writing.
If The Guest Agency needs to cancel or materially reschedule a project, we will notify you as soon as reasonably possible and discuss appropriate next steps, including any applicable refund of prepaid fees for services not provided.
Nothing in this section excludes any rights or remedies available under applicable consumer law.
6.4 Fees and Payment for Services
Payment terms will be outlined in the relevant proposal or agreement. Depending on the project, this may include an upfront deposit, staged payments, milestone payments or payment in full before work commences.
Any required deposit, booking fee or initial payment will be specified in writing. Work may not commence until the required payment has been received.
Invoices must be paid by the due date specified on the invoice. If payment is overdue, we may pause work or withhold further deliverables after providing appropriate notice, subject to the terms of the relevant agreement and applicable law.
Any applicable taxes, third-party costs, travel expenses, production expenses or other project-related costs will be disclosed in the proposal or otherwise agreed in writing before they are incurred.
6.5 Deliverables, Reviews and Approvals
Deliverables will be provided in the format and within the timeframe outlined in the relevant proposal or agreement.
Where review rounds or revisions are included, the number and scope of those revisions will be specified in the proposal. Additional revisions or changes beyond the agreed scope may incur additional fees.
Clients are responsible for reviewing and approving deliverables before publication, distribution, production or implementation. The Guest Agency is not responsible for errors introduced or changes made after the client's approval, except where liability cannot lawfully be excluded.
Where a client does not provide feedback or approval within an agreed timeframe, project timelines may need to be adjusted.
6.6 Third-Party Suppliers and External Costs
Some projects may involve third-party suppliers, venues, contractors, talent, production companies, platforms or other external providers.
Where third-party services are required, the responsibilities, fees and payment arrangements will be outlined in the relevant proposal or agreed separately.
Third-party costs may be subject to the supplier's own booking, payment, cancellation and refund conditions. Where those conditions apply to a project, they will be communicated to the client where reasonably practicable.
The Guest Agency cannot guarantee the availability or performance of independent third-party providers and will not be responsible for their acts or omissions to the extent permitted by law. This does not exclude any responsibility The Guest Agency may have for services it has agreed to provide directly.
6.7 Intellectual Property and Usage Rights
Unless otherwise agreed in writing, The Guest Agency retains ownership of its pre-existing intellectual property, including its proprietary methods, processes, templates, frameworks, tools and working materials.
Ownership and permitted use of project-specific deliverables will be outlined in the relevant proposal or agreement. Where applicable, any transfer or licence of rights may be conditional on payment of all agreed fees.
Clients are responsible for obtaining appropriate rights and permissions for materials they supply or ask us to use.
We will not use confidential client information for promotional purposes without permission. Any use of completed work in our portfolio, case studies or marketing materials will be subject to the relevant agreement and any applicable confidentiality obligations.
6.8 Results and Outcomes
The Guest Agency will perform agreed services with reasonable care and skill. However, marketing, communications and experiences projects can be influenced by factors outside our control, including market conditions, audience behaviour, platform changes, supplier performance and client implementation.
We do not guarantee specific commercial results, audience growth, revenue, media coverage, engagement levels or other outcomes unless expressly agreed in writing and legally enforceable.
7. Client Agreements and Priority of Terms
Where a separate proposal, statement of work, service agreement or booking agreement is entered into, that document will set out the specific terms applicable to the project.
These website Terms & Conditions apply generally, except where a project-specific agreement expressly varies them. Any agreed variation must be recorded in writing.
8. Complaints and Disputes
If a concern arises in connection with a purchase or project, we encourage you to contact us so we can work towards a reasonable resolution.
The parties agree to make reasonable efforts to resolve disputes through good-faith communication. If a matter cannot be resolved informally, the parties may consider an appropriate dispute resolution process before commencing formal proceedings, where suitable and permitted by law.
Nothing in this section prevents either party from exercising any legal rights or remedies available to them.
9. Nature of Digital Content and Services
The Considered Brand is an educational and practical resource intended to help users consider their brand strategy, positioning, messaging and consistency.
The 2027 Marketing Planner is a practical planning resource intended to help users establish marketing priorities, set goals, organise activities, track progress and reflect on results throughout the year.
Both products provide general guidance, prompts and planning tools. They do not constitute personalised professional, legal, financial or other regulated advice, and neither product guarantees any particular business or marketing outcome.
You remain responsible for the decisions you make and the actions you take when applying the content of these products to your business. Any strategies, plans or recommendations developed using these resources should be assessed in the context of your individual business circumstances.
While The Guest Agency aims to provide services with reasonable care and skill, we cannot guarantee particular commercial results or outcomes where these depend on factors outside our reasonable control.
10. Intellectual Property and Website Content
All content on this website, including text, graphics, branding, imagery, layouts and original materials, is owned by or licensed to The Guest Agency unless otherwise stated.
You may view and access our content for personal or legitimate business enquiry purposes. You must not reproduce, republish, distribute or commercially exploit our website content without our prior written permission, except where permitted by law.
Nothing in these terms transfers ownership of our intellectual property to you.
11. Third-Party Platforms and Links
Our website and online store are hosted through Squarespace, and payments and other website functions may rely on third-party providers.
We are not responsible for the independent terms, privacy practices or availability of third-party websites and services. Your use of those services may be subject to their own terms and policies.
This does not limit any responsibility we have under applicable law.
12. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under applicable law.
To the extent permitted by law, The Guest Agency is not responsible for losses arising from the misuse of our website or digital products, decisions made solely on the basis of general information in our content, or interruptions caused by circumstances beyond our reasonable control.
We do not guarantee that using our website, digital products or services will produce a particular commercial, financial or branding outcome.
Where liability can lawfully be limited, it will be limited to the extent permitted by applicable law.
13. International Customers
The Guest Agency may make products and services available to customers outside Australia.
If you purchase from outside Australia, you are responsible for ensuring that your use of the product or service complies with any laws applicable to you. You may also be responsible for any taxes, duties or other charges that apply to your purchase in your jurisdiction, where applicable.
Nothing in these terms is intended to exclude or override mandatory consumer protections that apply to you under the laws of your country or region.
14. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, products, services or legal obligations.
The latest version will be published on our website with the updated date. Changes will apply from the date they are published, subject to any legal requirements and the terms applicable to purchases or agreements already entered into.
We encourage you to review this page periodically.
15. Governing Law
These terms are intended to be governed by the laws of Queensland, Australia, and the applicable laws of Australia, subject to any mandatory laws and consumer protections that apply in your jurisdiction.
